1. Acceptance of Terms

Welcome to AndaaExam ("AndaaExam," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and Accounts

2.1 Minimum Age

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

Service features may evolve over time. We may add, modify, or remove functionality without prior notice.

4. Acceptable Use

You agree not to:

• use the Service for unlawful, fraudulent, or deceptive activities,
• upload content that infringes intellectual property or privacy rights,
• attempt to reverse engineer, disrupt, or overload the Service,
• scrape, copy, or automate access in a way that harms operations,
• upload malware, malicious code, or harmful payloads,

AndaaExam provides educational assistance tools and does not guarantee academic outcomes, exam scores, admissions, or certifications. You are responsible for your own study decisions and exam preparation strategy.

The Service does not replace professional academic counseling, medical advice, legal advice, or other regulated professional services.

6. User Content and License

6.1 Ownership

You retain ownership of your uploaded content (e.g., notes, syllabus files, personal inputs).

6.2 License to Operate the Service

You grant AndaaExam a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content solely to operate, secure, improve, and provide the Service.

6.3 AI Processing

By uploading learning content, you authorize processing by our AI and infrastructure providers as needed to generate summaries, plans, and quizzes.

6.4 Content Responsibility

You warrant that you have sufficient rights to upload and process submitted content.

7. Intellectual Property

All platform code, branding, design elements, trademarks, and non-user content are owned by AndaaExam or its licensors and are protected by applicable intellectual property laws.

Except where expressly allowed, you may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any part of the Service.

8. Payments, Subscriptions, and Refunds

8.1 Paid Features

Some features may require payment, subscription, or in-app purchases.

8.2 Billing

Where applicable, payments are processed through third-party providers (such as app stores or payment processors), and their terms also apply.

8.3 Renewal and Cancellation

If subscriptions are offered, they may auto-renew unless canceled in accordance with the relevant billing platform.

8.4 Refunds

To the fullest extent permitted by law, AndaaExam and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, goodwill, or educational opportunity, arising from or related to your use of the Service.

Our aggregate liability for claims related to the Service shall not exceed the greater of:

• the amount you paid to us in the 12 months before the claim, or
• USD 50.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless AndaaExam and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• your use or misuse of the Service,
• your violation of these Terms,
• your infringement of third-party rights,
• content you upload or share.

15. Governing Law and Dispute Resolution

These Terms are governed by applicable laws in the Democratic Republic of the Congo, without regard to conflict of law principles.

You agree to first attempt to resolve disputes informally by contacting us at hello@andaaexam.com. If unresolved, disputes may be submitted to competent courts, subject to mandatory consumer protections under local law.
